Judge not stepping down from case of Hialeah teen accused of murdering mother

The judge overseeing the case of a Hialeah teen accused of brutally stabbing his mother to death is staying on the case after denying a motion by the teen’s attorneys for him to remove himself.

In a ruling issued Monday, Judge Richard Hersch said the motion filed by attorneys for Derek Rosa is “legally insufficient.”

Attorneys for Rosa had claimed in their motion that Hersch’s conduct was “hostile and biased” and argued that the teen wouldn’t receive a fair trial if he stayed on the case.

Rosa had even signed an affidavit saying, “he has a well-grounded fear … that he will not get a fair trial.”…
