Richard Allen’s attorneys claim Feb. 12 hearing can’t happen until judge addresses their call for her removal

ALLEN COUNTY, Ind. — The defense team for the man accused in the Delphi murders is calling on the judge to vacate a scheduled Feb. 12 hearing claiming that no other motions in the case can be addressed until the court rules on the defense team’s motion to have the judge removed.

Previous stories detailed how Special Judge Fran Gull set a 9 a.m. hearing on Feb. 12 in Fort Wayne where the State and the defense team of Richard Allen would come together to discuss two recently filed motions.

These motions include a filing by Prosecutor Nick McLeland to amend the charges against Allen along with another filing by McLeland that seeks to hold Allen’s attorneys in contempt of court .

These 2 issues will be at the center of the Feb. 12 hearing in the Delphi murders case

Allen is currently charged with two counts of murder in the February 2017 deaths of Abby Williams and Libby German near the Monon High Bridge in Delphi. Allen’s attorneys, Bradley Rozzi and Andrew Baldwin, were recently reinstated on the case by the Indiana Supreme Court after Gull originally removed the pair following an evidence leak.
