Mother charged in deadly San Jose church exorcism makes RJA motion

SAN JOSE, Calif. (KRON) — A mother who is accused of killing her young daughter while performing a religious exorcism inside a San Jose church is seeking to have her case thrown out under California’s Racial Justice Act (RJA).

The mother, Claudia Elisa Hernandez, will appear in court on January 22 for an RJA evidentiary hearing. Defense attorneys are asking a Santa Clara County Superior Court judge to dismiss all charges based on the Racial Justice Act.

Hernandez’s case has slowly moved through the court system since her 3-year-old daughter, Arely Naomi Proctor, was killed on a church’s alter on Sept. 24, 2021.
