From the back of a new custom home in Frisco’s Stonebriar subdivision, a steep embankment dropped toward a creek and a golf course. After a couple first saw the house in 1998, the husband asked the builder’s owner whether it would slide off the hill, court records show.

The answer, he testified, was: “That shouldn’t be a problem. This house and lot [are] as solid as they come.” It was the first “million dollar” home the builder had built.

The couple closed on November 23, 1998. In August 2000, the soil on the south side of the foundation began cracking and pulling away from the back porch. The owner called it “normal settling” and told the husband to fill the area with sand…
