AUSTIN (KXAN) — Texas Attorney General Ken Paxton announced in a news release that he filed an appeal in the lawsuit over the city of Dallas and the State Fair’s new policy banning all firearms from its fairgrounds .
The State Fair announced earlier this year that “it would be banning people with license to carry permits from exercising their rights at Fair Park,” the release said.
“The City of Dallas and the Texas State Fair are not above the law, and we are seeking emergency relief to uphold Texans’ Constitutionally-protected Second Amendment rights,” Paxton said in the release.
Judge allows Texas State Fair’s gun ban to stand for now
In August, Paxton sued the city and State Fair saying the firearms ban was “unlawful,” the release said. However, a district court denied the AG office’s motion for a temporary injunction on that ban prompting Paxton to file an appeal.
Paxton is asking the court to “grant emergency temporarily relief” to prevent the city and State Fair from enforcing that ban, the release said.
