On Tuesday night, September 16th, at approximately 10:56 p.m., Irving Police officers were dispatched to the Valley Trails Apartments in the 8900 block of E. Valley Ranch Parkway following reports of a disturbance and possible shots fired.
Officers arriving on the scene observed the suspect, 26-year-old Nikolay Frank, driving through the parking lot. He was detained at gunpoint until additional officers arrived and took him into custody. Frank displayed signs of intoxication, including the smell of alcohol, bloodshot and glassy eyes, slurred speech, and unsteady movements. He admitted to consuming at least three shots and two beers that evening.
A field sobriety test revealed all six clues of Horizontal Gaze Nystagmus and vertical gaze nystagmus. Frank consented to a breath test, which measured a blood-alcohol content of 0.148…
