Grand Jury Convened in New York for Potential New Charges Against Harvey Weinstein

The Manhattan District Attorney’s office is currently presenting evidence to a grand jury related to a potential new charge against Harvey Weinstein. This charge concerns an alleged sexual assault that reportedly took place between late 2005 and mid-2006 in a residential building in Lower Manhattan. This revelation emerged from a transcript made public regarding an unannounced court session held earlier this week.

During a hearing on Tuesday, prosecutors mentioned knowledge of two additional incidents: a sexual assault purported to have happened in May 2016 at a Tribeca hotel, and another possible assault at the Tribeca Grand Hotel. Officials from the DA’s office have not commented on these proceedings.

Furthermore, the disclosure to Weinstein’s defense of these possible offenses by the prosecution does not confirm the specific charges to be included in any forthcoming indictment. The grand jury is scheduled to conclude its term by Friday, at which time a decision on charges may be made.

Weinstein’s legal representative, Arthur Aidala, indicated in the hearing that Weinstein is contemplating testifying before the grand jury himself. Aidala noted Weinstein’s intent to present his current physical condition to the jurors.

Weinstein, who denies any misconduct claiming the encounters were consensual, has a complicated legal history. His 2020 rape conviction was overturned by the New York Court of Appeals in a close 4-3 vote, and currently, he is held at Rikers Island as he appeals a separate conviction in Los Angeles. Additionally, this summer, the Manhattan DA’s office has indicated plans to retry Weinstein based in part on testimonies from other alleged victims not previously included in the original case.

The trial has been tentatively set for this coming fall.
