Diddy Seeks to Overturn $100 Million Judgment

Additional Coverage:

Music mogul Diddy is pushing back against a $100 million default judgment issued against him this week. He argues he was never served the lawsuit and that the statute of limitations expired years ago.

Diddy filed an emergency motion on Thursday to overturn the judgment, stating he was unaware of the lawsuit from Derrick Lee Cardello-Smith until it was reported by news outlets. Diddy’s lawyers argue that the case should be dismissed not only because he wasn’t properly notified, but also because the allegations are “completely fabricated.”

Even if the allegations were legitimate, Diddy’s legal team contends that the statute of limitations expired nearly 17 years ago. They further dismiss the lawsuit as frivolous, noting that Cardello-Smith is a convicted rapist with a history of filing unfounded lawsuits.

In case you missed it, Cardello-Smith was awarded $100 million by a judge after Diddy didn’t respond to the complaint filed in June. Cardello-Smith claims that in 1997, he and Diddy were involved with a group of women when Diddy allegedly touched him inappropriately and later spiked his drink, implying sexual assault upon waking.

The judge has mandated a payment plan of $10 million per month starting October 1.
