A 19-year-old subway rider testified that she was frightened by the erratic behavior of Jordan Neely, a homeless man, before Marine veteran Daniel Penny placed him in a chokehold.
Neely reportedly screamed and threatened passengers, causing the witness to fear for her safety. The witness claimed to have heard Neely say someone would die that day.
Juan Alberto Vazquez, a journalist who witnessed the incident, described Neely as “violent and desperate.” He expressed concern about Neely’s erratic behavior and feared he might be armed.
Penny, a 25-year-old Marine veteran, is facing charges related to Neely’s death. The trial is ongoing and resumes Tuesday at 10 a.m. ET.
Neely, a 30-year-old homeless man, had a history of mental illness and criminality, including an assault charge.
