Illinois Assault Weapons Ban Ruled Unconstitutional
A federal judge in Illinois has ruled the state’s ban on assault weapons violates the Second Amendment. The judge stayed the ruling for 30 days to allow for an appeal.
The Protect Illinois Communities Act, signed in January 2023, bans certain rifles, handguns, and high-capacity magazines. The judge argued that the ban does not comply with the Supreme Court’s framework for evaluating gun restrictions.
Gun Rights Advocates and Gun Control Supporters React
Dan Eldridge, a plaintiff in the case, praised the ruling as a victory for self-defense. Rachel Jacoby, a Highland Park resident affected by gun violence, criticized the ruling, calling it “a slap in the face” to victims.
State’s Response
Governor JB Pritzker’s office released a statement supporting the ban and expressing confidence in its constitutionality. The state plans to file an immediate appeal.
Pending Cases
Similar lawsuits challenging assault weapons bans are pending in Maryland and Chicago federal courts. The Supreme Court could potentially review the Illinois case if it takes up the Maryland case.
