Alabama is scheduled to execute Carey Grayson, 50, on Thursday using nitrogen hypoxia, a method that has been rejected by a U.S. court of appeals as unconstitutional.
Grayson was convicted in 1994 for the murder of Vickie Deblieux. His three co-defendants, who were minors at the time, are serving life sentences.
Grayson’s attorney, John Palombi, claims the nitrogen protocol used by Alabama has malfunctioned twice. However, the state is proceeding with the execution despite these concerns.
Grayson has a history of mental illness, including bipolar disorder. His mother also suffered from mental health issues.
Despite numerous appeals, Grayson’s death sentence has been upheld. However, his co-defendants were spared the death penalty due to a Supreme Court ruling that prohibits the execution of juveniles.
