Menendez Brothers’ Case Continues with Habeas Corpus Hearing

The highly publicized case of Erik and Lyle Menendez returned to court on Monday. The brothers faced a hearing regarding their habeas corpus petition, filed last year to review new evidence not presented at their trial.

Aunts Plead for Brothers’ Release

During the hearing, two of the brothers’ aunts testified via video due to health concerns. Joan VanderMolen, their mother’s sister, emotionally pleaded for their release, expressing that they endured horrific abuse at the hands of their father.

New Evidence at Center of Petition

The habeas corpus petition includes two new pieces of evidence: allegations of sexual abuse against the brothers’ father by a former member of Menudo, and a letter allegedly written by Erik Menendez detailing the abuse.

Paths to Freedom Explored

Aside from the habeas corpus petition, the brothers have other potential paths to freedom. Los Angeles County District Attorney George Gascón has recommended resentencing them for murder, making them eligible for parole.

However, newly elected DA Nathan Hochman will review the evidence before taking a position. Additionally, the brothers have submitted a request for clemency to Governor Gavin Newsom.

Next Hearing Scheduled

Judge Michael Jesic adjourned the hearing and set the next one for January 30 and 31, giving time for the new DA to review the case and for the brothers’ attorney to prepare their closing arguments.
