The owners of Peanut the Squirrel have filed a notice of intent to sue the State of New York for the death of their pet. Mark Longo and Daniela Bittner allege that the state violated their rights during a raid that resulted in the killing of Peanut and their raccoon, Fred.
Longo and Bittner claim that the raid was unlawful and that the state failed to disclose its intention to kill the animals. They also argue that Peanut and Fred were companion animals, not wild animals, and that they were executed without justification.
The owners believe that a 10-day quarantine would have been sufficient and that there was no basis to believe the animals had rabies. They are suing for emotional distress, pain and suffering, and lost wages.
The raid and subsequent deaths of Peanut and Fred have sparked outrage and led to calls for an investigation into possible government overreach.
