A federal judge has ruled that a lawsuit against Burger King can proceed, giving disgruntled customers a chance to argue their case. The lawsuit alleges that Burger King’s advertising misrepresents the size and appearance of its burgers, leading customers to purchase food they otherwise wouldn’t have.
Judge Roy K. Altman’s decision, issued earlier this month in Florida, acknowledges that the plaintiffs’ claims may have merit and are not simply based on exaggerated marketing.
Previous lawsuits against fast food chains over similar advertising practices have been dismissed, but this ruling signals a potential shift in legal interpretations of “truth in advertising” within the fast food industry.
