Federal Judge Narrows Blake Lively’s Lawsuit Against Justin Baldoni

A New York federal judge has dismissed the majority of Blake Lively’s sexual harassment and retaliation claims against actor-director Justin Baldoni, significantly narrowing the scope of the high-profile lawsuit.

On April 2, Judge Lewis Liman issued a detailed 152-page ruling that mostly granted a motion for summary judgment filed by Baldoni and his co-defendants, effectively avoiding a full trial originally set for mid-May. A virtual hearing was held later that day.

The lawsuit stems from allegations Lively made in 2024, first in California and later in New York federal court. She accused Baldoni and Wayfarer Studios CEO Jamey Heath of inappropriate workplace conduct and orchestrating a retaliatory “social manipulation” campaign against her after she raised concerns about safety on the set of It Ends With Us.

What Claims Survive?

Of the 13 claims Lively brought forward, only three will proceed to trial: breach of contract, retaliation, and aiding and abetting retaliation against Baldoni himself. The other claims involving Baldoni’s production company, the film’s LLC, and a PR firm accused of running a smear campaign were dismissed. Most notably, the sexual harassment and defamation claims were thrown out.

Judge Liman ruled that Lively was an independent contractor, not an employee, which barred her from bringing sexual harassment claims under the applicable federal law. He also noted the context of the alleged conduct-much of which involved on-screen romantic scenes-making it difficult to interpret Baldoni’s actions as hostile or gender-biased behavior.

Defendants Respond

The legal team representing Baldoni and co-defendants expressed relief at the dismissal of all sexual harassment claims and those against individual defendants. They emphasized their readiness to defend against the remaining charges, calling the narrowed case a “careful review” of the evidence.

The defendants have denied Lively’s accusations of a defamatory smear campaign, framing their actions as efforts to manage media fallout amid a deteriorating professional relationship.

Lively’s Side

Blake Lively’s attorney, Sigrid McCawley, clarified that the dismissal of sexual harassment claims was due to legal technicalities regarding employment status, not a reflection on the merits of her client’s allegations. McCawley reiterated that the case’s core focus remains on retaliation and reputation damage following Lively’s stand for safety on set.

Lively is prepared to testify and shed light on what her legal team calls a “vicious form of online retaliation,” hoping to bring accountability and awareness to such tactics.

Wider Impact

The dispute has drawn attention beyond the courtroom, revealing private communications involving other celebrities such as Taylor Swift, Matt Damon, Ben Affleck, and Jenny Slate. These documents, made public earlier this year, have added a layer of complexity and public interest to the case.

As the legal battle moves forward, both sides retain the right to appeal the judge’s rulings, keeping the spotlight on a high-stakes conflict within Hollywood’s intricate workplace dynamics.
