Family of woman killed in Tesla crash in Katy files lawsuit against company, driver

HOUSTON (CW39) — The family of a Houston-area woman who died after a Tesla crashed into her home is suing the company and the driver.

The suit blames a design defect for Friday’s crash when the Tesla 3 hit Martha Avila’s house in Katy.

Avila, 76, was killed in the crash. Her daughter, Jennifer Barbour, filed the lawsuit in behalf of her mother.

The driver, identified in the lawsuit as 44-year-old Michael Butler, told investigators with the Harris County Sheriff’s Office that he had the autopilot program on in the Tesla when it crashed.

The lawsuit comes after the National Highway Traffic Safety Administration is investigating the crash, focusing on the vehicle’s automated driving technology…
