Ex-DA Ogg airing of Jocelyn Nungaray evidence prompts ethics concerns from defendant’s lawyer

Former Harris County District Attorney Kim Ogg’s on-air revelations about the investigation of 12-year-old Jocelyn Nungaray’s rape and death have been flagged by the lawyer for one of the accused as a potential ethics violation.

An interview with a Houston television station detailed Ogg accusing Franklin Peña, a Venezuelan national charged in Jocelyn’s 2024 death, of sexually assaulting a U.S. traveler in Costa Rica at some point before his arrival in Texas. Her office learned about the allegation when a woman came forward after his arrest, she said.

Peña, who is charged with capital murder, entered the U.S. on May 29, but was apprehended by U.S. border agents and released days later, according to court records. Jocelyn was killed June 17. Her body was found in a bayou in the 400 block of West Rankin Road…
