Two local lawmakers are among those pushing a bill that would in some cases limit the discretion of prosecutors to propose bail rather than pretrial incarceration.
Reps. Parker Moore, R-Hartselle, and Ernie Yarbrough, R-Trinity, joined a group of 11 others cosponsoring House Bill 126, which was pre-filed Wednesday. HB126 would require the prosecution to request that bail be denied for a defendant charged with either a Class A felony that resulted in the death of another person or attempted murder.
“Its purpose is to try to help protect people in our communities,” Moore said. “(For) those that are in our system who don’t need to be getting out, it gives our legal system another tool to be able to keep them incarcerated that could potentially do more harm to people in the community.”…
