City of Huntsville asks judge for summary judgment, to close 708 Bar & Grille, citing ‘undisputed’ public nuisance claims

HUNTSVILLE, Ala. — The City of Huntsville has filed a motion for summary judgment, asking a Madison County Circuit Judge to permanently shutter 708 Bar & Grille.

The City argues that undisputed evidence identifies the establishment at 708 Poplar Avenue as a public nuisance and a site of persistent illegal activity. It seeks a favorable ruling that would head off a hearing scheduled for later this spring.

Grounds for Summary Judgment

The City’s filing highlights a history of violence and safety violations at the property, including:

  • Gun Violence and Crime: HPD responded to shooting incidents on May 5, 2024; August 2, 2024; and March 10, 2025. Other reported crimes include drug activity, assaults, and a fatal 2024 DUI incident involving a visibly intoxicated patrons.
  • Zoning & Code Violations: The bar allegedly operates with unpermitted entertainment (DJs), uses unauthorized patio areas, and serves alcohol after midnight in violation of the City’s Zoning Ordinance.
  • Public Disturbance: Residents have reported “burnouts” and loud music audible from a quarter-mile away, with crowds lingering until 4:00 a.m.

The motion claims the City has presented “undisputed evidence (that) shows that 708 Bar and Grille is blatantly violating the City’s Zoning Ordinance.”

Requests for Sanctions

The City is also seeking judgment based on the defendants’ repeated failures to defend the case. According to the motion, the owners failed to timely answer the complaint, missed a court-ordered hearing, and ignored multiple orders regarding the discovery process.
