Update in Carly Madison murder case: Prosecution requests for new trial motion to be denied

Nearly two weeks after a defense attorney for 15-year-old Carly Madison Gregg filed a motion requesting for a new trial , the prosecution is asking for a judge to deny the defense’s motion.

Court records show Rankin County Assistant District Attorney Kathryn Newman filed a response motion Monday in opposition of a new trial for Gregg, stating the defendant’s motion “fails to state the specific factual grounds and specific legal authority in support of her allegations.”

“Not liking the outcome of a trial, is not grounds for a new trial,” Newman later wrote in filing, referencing the Mississippi Rules of Criminal Procedure which outlines the grounds for a new trial.

On Sept. 20, a jury sentenced Gregg to life in prison without parole after finding her guilty of murdering her 40-year-old mother, Ashley Smylie , attempting to murder her 39-year-old stepfather, Heath Smylie , and tampering with evidence. The offense occurred on March 19 at the family’s Brandon home, when Gregg was 14 years old.
