Motion to dismiss filed over ‘prosecutorial misconduct’ in Jimmie ‘Jay’ Lee murder trial

OXFORD, Miss. – Defense counsel for Timothy Herrington, the man accused of murdering Ole Miss student Jimmie “Jay” Lee, filed a motion to dismiss the case due to what he called “egregious and repeated prosecutorial misconduct” on Tuesday.

In the filing, Herrington’s attorney, Aafram Y. Sellers, said that the District Attorney’s Office violated the Mississippi Rules of Professional Conduct, undermined the judicial process, and “irreparably prejudiced” Herrington’s Constitutional right to a fair trial.

Sellers also asked that, if the judge is unwilling to dismiss the case, then the District Attorney’s Office should be disqualified and the venue should be changed “based on the cumulative effect of the State’s misconduct.”…
