KANSAS CITY, Mo. – In a case that intertwines drug trafficking with violent crime, Ban N. To, a 20-year-old Kansas City resident and known gang member, has been sentenced to a substantial 20 years in federal prison without the possibility of parole. The sentencing, handed down by U.S. District Judge Greg Kays on Wednesday, Jan. 31, comes after To pleaded guilty to charges of fentanyl trafficking, illegal possession of firearms, and possession of a machine gun.
To’s sentencing exceeded the federal guidelines due to the gravity of his offenses, including his involvement in a deadly shooting in the Westport Entertainment District on April 15, 2023. Although not formally charged for the murder, evidence presented during the sentencing highlighted To’s alleged role in the homicide, with surveillance footage showing his participation in the fatal encounter. Judge Kays, in delivering the 240-month sentence, acknowledged the evidence suggesting To’s direct involvement in the killing.
The investigation into To’s activities began shortly after the Westport shooting, leading to the discovery of his involvement in fentanyl distribution. On June 21, 2023, To admitted to possessing fentanyl with intent to distribute, carrying firearms during drug-trafficking activities, and possessing a machine gun. The arrest and subsequent search of a red Toyota Highlander associated with To uncovered a cache of weapons, including a stolen Taurus .45-caliber handgun, a Glock 9mm, a Polymer80 9mm handgun without a serial number, and a Glock .40-caliber handgun modified for automatic fire.
