In the lawsuit, the Federal Trade Commission (FTC) and 11 other states filed a lawsuit against Walmart, claiming they were unfair and following “deceptive trade practices” related to the store’s Spark Driver program.
Some of the FTC’s claims of unfair practices within the program included things such as alleged misrepresentation of compensation and tip amounts to drivers before they accepted a job, reducing pay after delivery, telling consumers that all tip money went to drivers, failing to pay driver-incentive bonuses, and misrepresenting batching orders or splitting tips…
