Attorneys For The Menendez Brothers Withdraw Motion To Remove DA From Case

VAN NUYS (CNS) – Attorneys for Erik and Lyle Menendez Friday withdrew their motion asking that the Los Angeles County District Attorney’s Office be removed from the brothers’ case, saying they want to expeditiously move forward with their bid to have the pair re-sentenced and possibly be released from prison.

The brothers are serving life prison terms without the possibility of parole for the 1989 shotgun killings of their parents in Beverly Hills. Superior Court Judge Michael Jesic scheduled the hearing on the defense re- sentencing motion to be held Tuesday and Wednesday of next week.

The attorneys for the brothers had origially sought to remove Los Angeles District Attorney Nathan Hochman’s office from their resentencing case. The brothers, convicted of killing their parents in 1989, argued that Hochman’s bias and alleged mistreatment prevent a fair hearing. Hochman opposes their resentencing, stating the brothers have not fully admitted to their crimes. He also dismisses new evidence of abuse as irrelevant, claiming the murders were motivated by greed…
