LOUISVILLE, Ky. (KT) – A federal court has ruled in favor of a Louisville wedding photographer and blogger who challenged the city’s Fairness Ordinance. The U.S. District Court for the Western District of Kentucky held that Louisville’s enforcement of the ordinance violated Chelsey Nelson’s First Amendment rights.
The district court kept a permanent bar in place that prevents Louisville from enforcing its law against Nelson and ordered Louisville to pay Nelson damages for restricting her speech.
In a news release, the Alliance Defending Freedom (ADF) said it filed the lawsuit in 2019 because, “Louisville’s law prohibited Nelson from expressing her views on marriage on her studio’s website and threatened to compel her to create photographs and blogs celebrating a message about marriage she does not believe.”…
