Lubbock judge dismisses developer Dan Wilson Homes’ nuisance suit

A Lubbock District judge issued a ruling denying a luxury homebuilder’s request that a commercial developer buy a nearly $1 million home devalued by activity from a restaurant that sits across the street from it.

District Judge Phillip Hays granted on April 1 a motion for summary judgement dismissing the lawsuit filed by Dan Wilson Homes complaining that headlights from vehicles exiting The Shops at 114 Slide created a nuisance that hinders the sale of a $850,000 spec home in the 5000 block of 116th Street.

The lawsuit filed on Feb. 8, 2024, in the 99th District Court states that the activity from the commercial lot developed by Egenbacher Development Group created a nuisance that prevents Dan Wilson from selling the home…
