Affidavit: Man killed in North Lubbock shooting was ‘not a threat to anyone’

LUBBOCK, Texas — Court documents obtained by EverythingLubbock.com on Monday revealed more information about the murder of Joshua Rios, 38, at a bar in the 1800 block of Clovis Road.

EverythingLubbock.com previously reported officers were called to the 1800 block of Clovis Road on April 13.

Court documents said an employee at the El Santiago bar told police a woman showed up around closing time with her girlfriend and another woman. A man, later identified as Victor Yanez, 22, and two other women then joined the group. Court records said at closing, the woman who first showed up with her girlfriend was involved in a disagreement with Rios that “appeared to be deescalating.”

According to court records, Yanez intervened in the dispute with a pistol on his waistline. Yanez stated, “I’m going to blow his a** down,” as he walked towards a silver vehicle. The bar employee then told everyone to leave, according to court documents. Rios walked away, court records stated, and Yanez went to a silver car driven by a woman. Court documents said some other women in the group got in the car as well. According to court records, the employee saw the car drive up to Rios, fire several gunshots then leave the scene. Court records said security video backed up the employee’s story.

The woman who was in the verbal altercation with Rios provided a sworn statement and said Rios had commented on her looks, which started the argument. Court documents said the woman denied Yanez went out with their group. However, authorities already had spoken to multiple witnesses who placed Yanez at the scene at the time of the shooting.

“The victim, Joshua Rios, was not involved in any other altercation,” court records said. “Joshua Rios walked away and was not a threat to anyone.”…
