Mark Meurer, the newly sworn county commissioner for Precinct 2, on Tuesday asked a judge to throw out Jason Corley’s effort to get his seat back.
On December 8, County Judge Curtis Parrish declared Corley resigned his seat moments before a County Commissioners meeting. Parrish then administered the oath of office to Meurer.
Update:
After normal business hours Tuesday, Potter County Attorney Scott Brumley, acting for the State of Texas, filed a petition in favor of Corley. Brumley was appointed when Lubbock County District Attorney Sunshine Stanek asked to remove her office from the case. (See our explanation further into the original story.)
Brumley’s petition said in part, “… The Lubbock County Judge had no lawful authority to find or declare that Jason Corley had automatically resigned and thereby created a vacancy in the office of county commissioner for precinct 2 of Lubbock County. Since no vacancy in the office existed, the appointment of Defendant Mark Meurer to the office of county commissioner for precinct 2 of Lubbock County was unlawful and void.”…
