Smyrna man accused of DUI after crash leaves driver seriously injured

Eriberto Cante, 25, of Smyrna, is accused of driving a blue 2003 Toyota Rav4 while under the influence and crashing at the intersection of Church Street and N. Marietta Parkway in Marietta on Oct. 12 at 7:56 p.m., according to an arrest warrant from the Marietta Police Department.

Cante disregarded a red light at the intersection and caused his vehicle to be struck on the passenger side by another vehicle that had the right of way. The violation was caught on video by Cobb County Real Time Crime Center camera footage from the intersection. The crash caused serious bodily injury to a man, who was rendered unconscious by the crash and had to be extricated from the vehicle by the fire department. The victim received a brain bleed and multiple fractured ribs, which caused him to remain in the hospital for multiple days, according to the warrant.

During the on-scene crash investigation, an obvious odor of an alcoholic beverage could be smelled coming from Cante. He also possessed multiple opened and unopened bottles of Modelo Beer in the vehicle he was driving. Cante admitted that he had consumed five 16 ounce cans of the beer approximately 11 hours prior to the crash. Hospital records for Cante obtained under a search warrant showed that he had a blood alcohol content of .234 less than one hour after the crash.
