A Cobb County man who was arrested for attempted kidnapping in March filed a federal lawsuit on Monday, according to media reports.
Mahendra Patel was arrested in March after fellow Cobb resident Caroline Miller accused him of trying to kidnap her child during a trip to the Walmart superstore on Cobb Parkway. Patel was arrested three days later by Acworth Police, who said he had “fled” the scene.
His case was brought before a grand jury by Cobb County District Attorney Sonya Allen and in April, he was indicted on three charges: criminal attempt to commit kidnapping, simple assault and simple battery.
