PHOENIX (AZFamily) — A woman has filed a complaint to sue the United States Marshals Service (USMS) after a case of mistaken identity when she was arrested at her Phoenix home last year.
Penny McCarthy, who was 66 at the time, was at her home after work on March 5, 2024, when she says three unmarked white vans pulled up to her driveway and began yelling that they had a warrant out for her arrest. In a body-cam video from the incident, officers from the USMS can be heard ordering McCarthy to put her hands behind her back and look away.
However, McCarthy’s attorneys say USMS did not have a warrant out for her arrest but a 25-year-old warrant from an Oklahoma court for someone named Carole Anne Rozak. Institute for Justice, a nonprofit public interest law firm that works to protect the Fourth Amendment and is listed as one of McCarthy’s attorneys on the complaint, says she is not connected to Rozak and never has been…
