East Valley Institute of Technology in Mesa fires new shot in war with 9 area school districts

The East Valley Institute of Technology last week asked a judge to dispense with a hearing and use the court filings to decide the lawsuit filed by nine East Valley school districts against it.

And according to the “motion for judgment on the pleadings,” EVIT said there’s only one way for Maricopa County Superior Court Judge Christopher Coury to rule.

“This case presents a pure question of statutory interpretation: Who has authority to determine how state funding generated by students enrolled in satellite career and technical education (“CTE”) courses is apportioned?

“The answer is supplied by the plain language of (state law): ‘The school district or charter school and the career technical education district shall determine the apportionment of the average daily membership for that pupil between the school district or charter school and the career technical education district.’…
