A 68-year-old Miami man is behind bars after being accused of inappropriately touching an 11-year-old girl at a hotel pool. Osvaldo Diaz faces charges of lewd and lascivious battery on a child and burglary with assault or battery, stemming from the incident that occurred at the Radisson Resort on Collins Avenue. According to NBC Miami, the victim and her family, tourists from Sweden, were enjoying an afternoon swim when the alleged contact happened.
Witness reports and the arrest report reveal that the young girl thought the initial contact was accidental and attempted to swim away. However, Diaz followed her, then reached for her and grabbed her between the legs, as stated in the police report obtained by NBC Miami. The girl’s father followed Diaz after his daughter alerted him, leading to a confrontation that took place after Diaz fled to a neighboring hotel.
The situation escalated as hotel security and eventually the police became involved. Security personnel were able to maintain a visual on Diaz until law enforcement officers arrived at the scene. WSVN reports that Diaz claimed to have been at the pool with friends, although he admitted to seeing the girl but denied any interaction.
