Prosecutors, defense clash over whether murder charge can be reinstated in Mobile slaying

MOBILE, Ala. (WALA) – Haratio Donzell Stewart was supposed to go on trial this week on a murder charge; instead, prosecutors asked that the case be dismissed, and now a legal fight will determine whether prosecutors can bring the case back.

Charges stem from a Christmas Eve shooting in 2023 at the Maison De Ville apartments. Jabyron Nettles died and his girlfriend, Jelaysia Smith, suffered serious injuries.

The Mobile County District Attorney’s Office told FOX10 News that “evidentiary issues” prevented prosecution. Mobile County Circuit Judge Brandy Hambright granted a request by prosecutors to dismiss the charges and allow them to reinstate the charges at a later date…
