Perez, who was 19 at the time, is accused of shooting and killing undercover police officer Sean Tuder with a stolen gun in January 2019 at the Peach Place Inn. Prosecutors are seeking the death penalty.

The defense argued Tuder was not acting in an official capacity at the time of the shooting. Due to working undercover, Tuder was wearing civilian clothes, no bulletproof vest or body-worn camera.

In the video, Perez said Tuder pulled up in an unmarked car, got out with his gun drawn, didn’t say anything to identify himself as a police officer and didn’t present a badge.

Perez admitted that the two got into a fight, and after noticing that Tuder had holstered his gun, Perez managed to stand up before firing multiple rounds.
