Lawyers for Jawan Dallas object to recommendation that parts of wrongful-death suit be dismissed

MOBILE, Ala. (WALA) – Attorneys for a man who died during a confrontation with police two years ago have objected to a federal magistrate judge’s recommendation that much of a wrongful-death lawsuit be dismissed.

U.S. Magistrate Judge Bradley Murray issued the opinion earlier this month, determining that only claims that deal directly with the death of Jawan Dallas be allowed to continue. That ruling is advisory only. U.S. District Kristi DuBose will have the final say.

Attorneys for the Dallas family responded, urging the judge to disregard Murray’s recommendation. The lawyers wrote that Mobile police officers Jared Hutto and Christian Davila violated Dallas’ constitutional rights on July 2, 2023, when they placed in handcuffs while they were investigating a burglary attempt in Plantation Mobile Home Park in Theodore.
