Judge considers whether Mobile man can be tried again after murder acquittal

MOBILE, Ala. (WALA) – A judge Wednesday heard arguments over whether a man who was acquitted of a murder charge can be prosecuted for conspiracy to commit murder.

Prosecutors got an indictment against Kentrell Darnell Freeman on the newest charge after a jury found the 26-year-old Mobile man not guilty in October in the fatal shooting of 14-year-old Daniel Blackmon on Cheshire Drive near Interstates 10 and 65.

Defense attorney Buzz Jordan argues the new charge amounts to double jeopardy, which the Constitution prohibits.

“My understanding is that it’s going to be the same facts, the same witnesses, the same alleged victim,” he told Mobile County Circuit Judge Michael Windom during Wednesday’s hearing. “They can’t do that.”…
