Former MPD sergeant’s termination upheld after evidence tampering in fatal DUI crash

MOBILE, Ala. (WPMI) — The Mobile County Personnel Board has determined former MPD Sgt. C. Gary Rogers removed evidence and impeded the investigation of a DUI fatality. The board upheld his termination in a September 9th order.

On November 23, 2024, Rogers was off-duty at home with his wife Courtney when a neighbor called them to an accident involving their 17-year-old son near the entrance of their neighborhood on Lott Road. Their son survived and was later charged with with extreme indifference murder for the fatal crash that killed 19-year- old Nolan McDavid, who was from Citronelle. The indictment alleges the teen was under the influence of alcohol and speeding on Lott Road when he crossed the center line and hit McDavid. The criminal case is no longer public record, indicating he was granted youthful offender status.

Rogers appealed his termination and during an August 26th appeal hearing the personnel board heard testimony from Rogers’ neighbor Wesley Russell. Russell stated Courtney handed him a fleece jacket her son had been wearing the night of the accident that she removed to examine his injuries while they were on scene. The order states, “Russell testified that he ‘felt like’ the shape of at least two ‘glass bottles’ wrapped in the jacket.” He said Gary grabbed the jacket and “said here I got it and proceeded to walk off and put it in the back driver floorboard of his Tahoe.”…
