MOBILE, Ala. (WALA) – The judge presiding over the capital murder trial of Darius Janoski Lucky Jr. granted a request Monday for the defense to review screenshots of a rap music video that was the subject of testimony last week.
Mobile County Circuit Judge Ben Brooks ordered that the screenshots be turned over to the defense, along with a transcript of the lead detective’s testimony. He paused the trial until Wednesday.
Lucky’s lawyers made the request on Sunday after complaining that they had not received the screenshots, purportedly from an Instagram account, that Sgt. Jermaine Rogers testified about. Prosecutors contend that Lucky, 20, of Mobile, was wearing almost the exact same clothing worn by an armed man that prosecutors contend was Lucky at an apartment complex in Eight Mile.
