Federal judge throws out Tennessee Education Association’s challenge to divisive concepts law

BLOUNT COUNTY, Tenn. — A federal judge in Nashville has dismissed a lawsuit filed by the Tennessee Education Association over the state’s divisive concepts law, which pertains to all K-12 public and charter schools in Tennessee.

U.S. District Court Judge Aleta A. Trauger wrote she found the plaintiffs have “failed to establish standing to bring suit” and dismissed the case. When someone lacks standing, that means the court finds that they haven’t been personally or directly impacted by the law.

The lawsuit, filed in July 2023, targets the “Prohibited Concepts Ban” that Gov. Bill Lee signed into law on April 22. The law prohibits 14 concepts from being included in the educational curriculum that pertain to things like gender and race…
