Man convicted in Heather Elvis’ kidnapping wants new trial

HORRY COUNTY, S.C. (WBTW) — One of two people convicted in the kidnapping of Heat h er Elvis, who disappeared in December 2013 , wants a new trial, according to a document filed Wednesday.

Sidney Moorer filed a post-conviction relief form in Horry County Common Pleas Court. He was first found guilty of obstruction of justice in September 2017 in connection with Elvis’ disappearance before being found guilty on the kidnapping charge during a 2019 retrial.

The document seeks a “new trial in a different venue and/or a sentence relative to criminal history, character statements + lack of evidence of a crime.” Moorer claims the prosecution changed their story and timeline in the Elvis case to get a conviction.

Moorer also claims evidence was withheld because the prosecution “knowingly allowed multiple witnesses to lie under oath even though they had evidence to the contrary” and “withheld evidence that may have revealed actual perpetrator.”

The document further claims Moorer had ineffective counsel and that attorney James Galmore “did very little work” and “argued nothing.”…
