Union City Municipal Court Judge Carlos Acosta Jr. could soon settle a legal malpractice lawsuit stemming from the dismissal of a personal injury case he took on as an attorney in 2013, based on a summary judgement issued in the case last week.
Meanwhile, his former partner James Mescall from their law firm Mescall & Acosta P.C., had the complaint against him by both Ana Cruz-Sosa and Acosta dismissed with prejudice, meaning it cannot be refiled.
While a trial is technically set to begin in August, a settlement agreement is in negotiations and could be reached before the end of June.
“The undisputed facts establish that Acosta, not Mescall, was solely responsible for the handling and neglect of Plaintiff’s case,” Essex County Superior Court Civil Presiding Judge John Zunic wrote in his June 18th decision…
