NY seeks dismissal of federal lawsuit challenging ‘Green Light Law’

ALBANY — The state attorney general’s office has asked a federal judge to dismiss a lawsuit filed last month by the U.S. Department of Justice challenging a New York law that has allowed thousands of nonresident immigrants to obtain driver’s licenses. The law also blocks federal immigration and border enforcement agencies from accessing the state’s motor vehicle database.

In a motion responding to the federal lawsuit, the attorney general’s office said the 2019 Driver’s License Access and Privacy Act, known as the “Green Light Law,” is “a valid exercise of the state’s traditional police powers, and the state’s decision to disregard immigration status and protect personal information does not violate any provision of federal law or obstruct enforcement of the federal immigration laws.”
