A legal challenge to Montclair Public Schools’ March 10 referendum will move forward after a judge rescheduled a hearing when the district failed to appear in court Monday.
Resident activist David Herron appeared before Superior Court Judge Robert Gardner to argue his claims, but nobody appeared for the district, prompting Gardner to question if Herron properly served the complaint. It is one of two lawsuits Herron has pending that challenge the referendum in which voters narrowly approved a one-time, $12.6 million tax increase.
New Hearing Date
Gardner rescheduled a hearing for both cases for 9 a.m., May 20.
Herron, who is representing himself, told the judge that he notified the district in an email with a copy of the order to show cause. Gardner, however, said the email notification “is not valid service.”…
