The San Mateo County District Attorney’s office will not file charges against a Bay Area man who was arrested this week on suspicion of persistently stalking — and on one occasion — pouring gasoline on a woman, District Attorney Steve Wagstaffe said Friday.
Dereck Estores, 59, was arrested Wednesday in Millbrae, a day after a 63-year-old woman in Kings Mountain reported that a “known suspect” had visited her house, unannounced, at least 41 times over the two years. In addition to the alleged visits, the woman said Estores had called her 21 times and left 24 notes at her home.
But because none of those notes, calls, or visits explicitly included a threat of harm, prosecutors cannot charge him with stalking, Wagstaffe said, noting the incidents would boil down to harassment, which is a civil matter in California…
