Walmart says Ocala woman lacked ‘caution’ and ‘care’ to avoid falling Gatorade case

In response to a lawsuit filed by an Ocala woman who claims her foot was fractured by a case of Gatorade that fell from a high shelf, the Walmart where the alleged incident occurred claims the customer should have “taken greater caution” and failed to use “reasonable care for her own safety” to avoid injury.

On June 18, Wal-Mart Stores East, LP, filed its Answer and Affirmative Defenses in response to a lawsuit filed by Blair Calloway in the Fifth Judicial Circuit Court of Marion County.

According to the lawsuit, which was filed by her attorneys on May 7, Calloway visited the Walmart at 34 Bahia Avenue in Silver Springs Shores on May 23, 2024. During her visit, Calloway says she grabbed some Gatorade off a high shelf where the drinks were stacked. She claims that when she “pulled one down, another drink fell from the shelf” and landed on her right foot, fracturing it in the process…
