Developer disputes Marion County’s denial of proposed apartments as ‘unreasonable, unlawful’

A developer who was denied a request to create 151 more apartments next to a site that’s already been approved for 869 other apartments has filed a dispute with the state, claiming Marion County officials acted in an “unlawful” manner that “unfairly burdens the use of the property.”

The request from Lake Louise, LLC, will be discussed during the Marion County Board of County Commissioners’ regular meeting on Tuesday, August 5.

According to state corporate records, Lake Louise, LLC, is registered to John and Shirley Rudnianyn. The property owners want to rezone the 9.51-acre site from single-family dwelling (R-1) to planned unit development (PUD) to allow for the creation of 151 apartments…
