Judge dismisses charges against man accused of killing Oklahoma County deputy

Oklahoma County prosecutors have dismissed charges against Benjamin Plank, the man accused of ambushing and killing Deputy Bobby Swartz during an eviction in 2022.

Swartz and his partner, Deputy Mark Johns, were shot while serving an eviction notice in southeast Oklahoma City. Plank was arrested and charged in connection with the shooting. Swartz later died from his injuries.

Plank has spent most of the past three years in custody of the Oklahoma Department of Mental Health and Substance Abuse Services at the Oklahoma Forensic Center in Vinita, undergoing a court-ordered competency evaluation and treatment. He was first admitted in April 2023…
