Midwest City is cleared by judge to acquire Heritage Park Mall

Midwest City is likely to gain control of the blighted Heritage Park Mall within the next few weeks following a pair of recent court rulings issued against owner Ahmad Bahreini.

Bahreini’s attempt to stop the city from using eminent domain to acquire the property was rejected by U.S. Judge Joe Heaton in December and Oklahoma District Judge Amy Palumbo ruled on Monday, Jan. 13, that the city can proceed with taking control of the mall.

Bahreini could not be reached for comment. He has until Jan. 22 to appeal the federal court ruling and 30 days from the court clerk’s filing of Palumbo’s ruling to file an appeal. City attorney Don Maisch said that unless Bahreini obtains a stay on Palumbo’s decision, Bahreini will be given 90 days to remove his personal property being stored inside the mall…
