New judge to step in for downtown Orlando nightlife lawsuit

A Jan. 2 legal filing showed that Judge Wendy Berger no longer is presiding over a nightlife-related case filed by several downtown bars and clubs against the city of Orlando and Orlando Police Department. Berger and Magistrate Judge Embry J. Kidd previously were assigned the case.

Orlando attorney Joel Leppard said Berger has a double case load, so the change could be due to responsibilities being reassigned, part of routine administrative procedures to balance caseloads amongst judges. Further, he said, such changes happen a bit more in January than at other times of the year.

Attorneys for the defendants did not respond to a request for comment prior to publication. Robert Peck, the plaintiffs’ attorney, concurred with Leppard.
